Terms of Service
Last updated: 28 October 2026
These terms are provided by Studio 404 d.o.o., Gradišče 15c, 1360 Vrhnika, Slovenia, EU, VAT ID SI42531357 ("SpacePost", "we", "us"), contact: legal@spacepost.dev.
1. Agreement and eligibility
By creating an account or using the SpacePost email API, SMTP relay, dashboard, SDKs, CLI or other services (the "Service"), you agree to these terms, the Acceptable Use Policy, and, where we process personal data for you, the Data Processing Addendum. The Service is intended for businesses and developers. If you accept on behalf of a company, you confirm you have authority to bind it. You must be at least 18 years old.
2. The Service
SpacePost provides an API and tools for sending transactional and permission-based email, delivered through Amazon SES. We may improve, change or retire features. We will give reasonable notice of changes that materially reduce functionality you rely on. Beta and planned features are provided as-is.
3. Your account
- Provide accurate information and keep your credentials and API keys secure. API keys are shown once and we cannot recover them. You are responsible for activity under your account and keys.
- Tell us promptly at legal@spacepost.dev if you suspect unauthorised access.
4. Your content and responsibilities
You own your content, recipient data and messages ("Customer Data"). You grant us a limited licence to process Customer Data only as necessary to provide the Service, keep it secure, prevent abuse and comply with law. You are responsible for the content you send, for having a lawful basis and any required consent to email your recipients, and for complying with the Acceptable Use Policy and applicable law, including email, privacy and consumer-protection rules.
5. Plans, fees and billing
- Plans, included volumes and overage rates are listed on the pricing page. At the time of writing: Free (3,000 emails a month), Pro (€9 a month), Scale (€35 a month). Each recipient counts as one email.
- Paid plans are billed per UTC calendar month, in advance, to the card you save at checkout (payments are processed by Stripe). The first month is charged pro rata for the days remaining. Overage for a month is charged together with the next month's fee on or after the 1st. We issue a tax invoice for every payment.
- Prices are in euros (EUR) and exclude VAT; VAT is added where applicable. Business customers in the EU with a valid VAT number are invoiced under the reverse-charge mechanism.
- Upgrading takes effect immediately and is charged pro rata for the rest of the month. Downgrades take effect at the start of the next month.
- You can cancel at any time; cancellation takes effect at the end of the paid month. Fees already paid are not refundable except where required by law or stated otherwise by us.
- We may change prices with at least 30 days' notice; changes apply from your next billing period. If a payment fails we retry it and notify you; if it is still unpaid 7 days after the first failure, your team moves to the Free plan (your data is kept).
- The Free plan stops at its monthly limit and is never billed.
6. Acceptable use and suspension
You must follow the Acceptable Use Policy. We may suspend or restrict sending immediately when we reasonably believe it is necessary to protect recipients, our infrastructure, our email provider relationship or other customers, or to comply with law. We will notify you and work with you to resolve the issue where we can.
7. Availability and support
We aim for a reliable service and publish incidents on our status page, but we do not currently offer a contractual uptime commitment unless agreed in writing on an Enterprise plan. Email delivery depends on third parties (including recipient mail servers), and we cannot guarantee that any message will be delivered or placed in the inbox.
8. Intellectual property
We and our licensors own the Service, its software, documentation and brand. We grant you a non-exclusive, non-transferable right to use it during your subscription. Our open-source components are licensed under their own licences. Feedback you give may be used by us without obligation.
9. Confidentiality and data protection
Each party will protect the other's non-public information with reasonable care. Our handling of personal data is described in the Privacy Policy; for Customer Data containing personal data we act as your processor under the DPA.
10. Warranty disclaimer
The Service is provided "as is" and "as available". To the extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. Nothing in these terms excludes liability that cannot be excluded by law, such as for intent or gross negligence.
11. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue, data or goodwill. Our total liability arising out of the Service in any twelve-month period is limited to the fees you paid us in the twelve months before the event giving rise to the claim (or EUR 100 if you are on the Free plan).
12. Indemnity
You will defend and indemnify us against third-party claims and regulatory actions arising from your Customer Data, your breach of the Acceptable Use Policy, or your violation of law, to the extent permitted by law.
13. Term and termination
These terms apply until terminated. You may stop using the Service and delete your account at any time. We may terminate for material breach, for abuse, or on 30 days' notice. On termination we delete Customer Data according to the retention periods in the Privacy Policy; you can export logs before then.
14. Changes to these terms
We may update these terms; for material changes we will notify you by email or in the dashboard at least 30 days in advance. Continued use after the effective date means you accept the updated terms.
15. Governing law and disputes
These terms are governed by the laws of the Republic of Slovenia, without regard to its conflict-of-laws rules. The competent court in Slovenia has jurisdiction, except where mandatory consumer law gives you the right to bring proceedings elsewhere. Nothing limits rights you may have as a consumer under EU law.
16. General
These terms, with the policies referenced above, are the entire agreement between us regarding the Service. If a provision is unenforceable the rest remains in force. You may not assign these terms without our consent. Notices to you may be sent to your account email; notices to us go to legal@spacepost.dev. SpacePost is not affiliated with Resend or Amazon Web Services.
